The Gujarat government denied Modi had made the speech. At a press conference, bjp president Venkaiah Naidu, with deputy PM Advani sitting beside him, informed members of the press that Modi had personally assured him he had not made the said remarks.

Star News obtained the audio recording of the speech and telecast the venomous speech in its news broadcast. It proved that Modi not only infringed the law, he compounded his crime by lying about it.

It is the central government's duty to dismiss Narendra Modi as caretaker CM of the state. The central government is inert. It will remain inert. The home ministry has already exposed its inability to rise above brazen partisanship to meet its legal or constitutional responsibilities with regard to Gujarat.

The central government is not discharging its constitutional duty because of partisan political considerations. The consequences could be grave. An atmosphere of terror and hatred generated by the Gujarat government could make a mockery of free electoral choice and subvert the democratic process.

What is the remedy? It lies with the president. He can invoke Article 78(C) of the Constitution and direct the council of ministers to consider the home minister's failure to act, regarding violation of law by the Gujarat CM. But even after a presidential directive, the cabinet may not act.

Thereby the president's constitutional responsibility to abide by the advice of the cabinet would come into conflict with his oath to uphold the Constitution and law. In the event, the president would have three options. He could ignore his oath to protect the Constitution and compromise with the situation. Or, to protect the Constitution he could take the extreme step of dismissing the central government and risk facing impeachment. Or, expressing his inability to abide by his oath to protect the Constitution, he could offer to resign.

How will President Kalam deal with the situation? The people will watch him. Posterity will judge him.
