A fresh First Information Report was filed for the case of a minor girl being stabbed by her stalker three months back in the Shahbad Dairy area of Delhi. The police have filed a new FIR with rape charges and will be investigating if the victim was sexually abused by her killer.
The FIR was reportedly registered at Shahbad Dairy police station under the Indian Penal Code section 376 for rape and under the Protection of Children and Sexual Offences Act.
A police officer said that the forensic science laboratory results of the victim indicated the occurrence of sexual assault before her death, he told the Hindustan Times, “We received the FSL report last week. Since the report suggested that the victim was sexually abused, we registered a separate FIR."
He further said, “It does not matter whether or not the victim gave her consent to have sex because she was a minor." The officer further mentioned that the police would investigate if the victim was abused by the murder accused Sahil or someone else.
What happened to the minor girl?
The 16-year-old girl was the former girlfriend of the accused 20-year-old Sahil who was stabbed at least 16 times and later bludgeoned to death by him on May 28 in the Shahbad Dairy area in Delhi on the roadside. The whole act was captured on the CCTV camera placed nearby which also showed that there were several passersby who did not stop the man from committing the crime.
The accused had fled to his relative's home in Bulandshahr in Uttar Pradesh after the crime but was arrested the next day by the police who traced his calls.
According to the reports, Sahil was initially booked for murder and later the police added other Indian Penal Code sections 354(a) (sexual harassment), and 509 (insulting the modesty of a woman), and sections of the Arms Act, the Protection of Children from Sexual Offences (Pocso) Act, and the Scheduled Caste and Scheduled Tribe Act.
The victim's samples were sent to he FSL to determine if she was sexually assaulted before the murder.
